IT IS PROVIDED FOR USE, NOT FOR REDISTRIBUTION, REHOSTING, REPACKAGING, OR CREATION OF COMPETING SOFTWARE. By selecting "I Agree," creating a project, opening a project, importing a project, or otherwise using the Remanet Builder after being presented with these terms, you acknowledge that you have read and agree to this License. If you do not agree to this License, do not use the Remanet Builder. Remanet is provided for use through the official Remanet website. It is not open-source software and is not licensed for redistribution, rehosting, repackaging, or creation of competing software except as expressly provided in this License or the separate Remanet Export Runtime License. For purposes of this License: "Remanet" means the software product known as Remanet. "Remanet.art" means the official Remanet website and any official subdomains or successor domains controlled by the copyright owner. "Remanet Builder" means the Remanet browser-based exhibition-authoring application, including its original source code, object code, compiled or bundled JavaScript, HTML, CSS, user interface, visual design, documentation, data structures, original assets, and other proprietary components. "Remanet Runtime" means the limited software components intentionally included by Remanet inside a legitimately exported exhibition for the purpose of displaying and operating that exhibition. "Exported Exhibition" means an exhibition package legitimately generated through the Remanet Builder. "User Content" means artwork, photographs, panoramas, text, audio, video, metadata, exhibition information, and other material supplied by a user. ## 1. LIMITED LICENSE TO USE THE BUILDER Subject to compliance with this License, Remanet grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Remanet Builder through Remanet.art solely for the purpose of creating, editing, previewing, and exporting exhibitions. Remanet is currently made available without charge. Free access does not place the Remanet Builder in the public domain, make it open-source software, or grant any ownership interest in the software. Except for the rights expressly granted in this License, no rights are granted by implication, estoppel, exhaustion, or otherwise. ## 2. OWNERSHIP OF REMANET The Remanet Builder and all copyrightable original material contained in it are owned by the copyright owner or, where applicable, licensed from third parties. All right, title, and interest in the Remanet Builder remain with their respective owners. Nothing in this License constitutes a sale or transfer of ownership of the Remanet Builder or any portion of it. The availability of browser-delivered code, compiled code, scripts, assets, network resources, or other Remanet components does not grant permission to reproduce, redistribute, modify, rehost, republish, or commercially exploit those components except as expressly authorized by this License. ## 3. PROHIBITED USES Except to the extent that a restriction is prohibited by applicable law or an applicable third-party license expressly grants broader rights, you may not directly or indirectly: a. copy, reproduce, download, archive, republish, distribute, or redistribute the Remanet Builder or a substantial portion of it for use as software separate from Remanet.art; b. host, mirror, proxy, frame, reproduce, or operate the Remanet Builder, or a substantially similar copy of it, on another domain, server, application, platform, or service; c. create, distribute, operate, or assist in creating a clone, fork, derivative application, competing exhibition builder, hosted virtual-tour builder, white-label version, software-as-a-service offering, or other software product substantially derived from proprietary Remanet Builder code; d. sell, rent, lease, sublicense, assign, commercially distribute, or otherwise commercially exploit the Remanet Builder or access to it; e. extract, isolate, package, publish, or redistribute proprietary Remanet Builder components for use in another product or service; f. reproduce the Remanet user interface, original visual assets, documentation, or original code in a manner that infringes Remanet intellectual-property rights; g. remove, obscure, alter, or falsify copyright notices, license notices, attribution, proprietary notices, or other rights-management information contained in the Remanet Builder; h. use the Remanet name, Remanet.art name, logos, trade dress, or branding in a way that falsely suggests sponsorship, endorsement, affiliation, partnership, certification, or official status; i. use proprietary Remanet Builder code to train, create, generate, or materially assist in the creation of a competing software product where doing so would violate copyright, this License, or other applicable law; j. circumvent or attempt to circumvent reasonable technical measures intended to control unauthorized access to non-public Remanet systems, source repositories, administrative functions, or restricted resources; k. access non-public source code, systems, credentials, infrastructure, or administrative interfaces without authorization. Nothing in this section limits lawful activity that cannot be restricted under applicable law, including rights expressly provided for interoperability, security research, or other statutory exceptions. ## 4. NO OPEN-SOURCE LICENSE Remanet is not licensed under the MIT License, GNU GPL, Apache License, BSD License, Mozilla Public License, Creative Commons license, or any other open-source or source-available license unless a specific component expressly states otherwise. Access to browser-delivered Remanet code does not constitute publication of source code under an open-source license. No permission is granted to maintain or distribute an unofficial Remanet fork, clone, mirror, or alternative hosted instance. ## 5. USER CONTENT REMAINS THE USER'S Remanet does not claim ownership of User Content. You retain whatever copyright, trademark, publicity, contractual, or other rights you already possess in artwork, photographs, panoramas, text, audio, video, metadata, exhibition design, and other material you provide to Remanet. Using Remanet does not transfer those rights to the copyright owner of Remanet. You are responsible for ensuring that you have sufficient rights to use any third-party material you include in an exhibition. ## 6. PROJECT DATA Remanet is designed around local-first processing. Unless a feature clearly states otherwise, project content intended for exhibition creation should be processed within the user's browser rather than uploaded to Remanet for storage. Actual network behavior, analytics, third-party resources, optional integrations, embeds, error reporting, or similar functionality must be accurately disclosed in Remanet's Ownership & Privacy information. Nothing in this License grants Remanet ownership of user project data. ## 7. EXPORTED EXHIBITIONS Remanet's restrictions on the proprietary Builder do not prevent users from exercising the rights intentionally granted for Exported Exhibitions. Subject to third-party rights and the Remanet Export Runtime License, a user may: * publish an Exported Exhibition; * host it on any compatible website or server; * copy it; * back it up; * archive it; * preserve it; * transfer it to another host or custodian; * provide it to a gallery, museum, school, archive, collector, institution, or other party responsible for maintaining it; * modify project-specific exhibition files; * modify the included Remanet Runtime to the extent permitted by the Remanet Export Runtime License. An Exported Exhibition must not require continued access to Remanet.art for ordinary operation unless an optional external feature is clearly identified as requiring such access. The rights granted for Exported Exhibitions do not grant a right to extract proprietary Remanet Runtime code for the primary purpose of creating a competing exhibition-building product or general-purpose software library. ## 8. REMANET EXPORT RUNTIME Any Remanet Runtime intentionally included in an Exported Exhibition is licensed separately under the Remanet Export Runtime License accompanying that export. Where this License conflicts with the Remanet Export Runtime License with respect to an exported Runtime component, the Remanet Export Runtime License governs that component. Nothing in the Remanet Export Runtime License grants rights to proprietary portions of the Remanet Builder that are not included in the Exported Exhibition. ## 9. THIRD-PARTY COMPONENTS Remanet may incorporate or interact with third-party libraries, frameworks, fonts, icons, media, or other components. Third-party components remain subject to their respective licenses. Nothing in this License reduces, overrides, or restricts rights granted by a third-party license. Required copyright notices, attribution, license texts, source-code offers, and similar notices must be preserved where applicable. ## 10. FEEDBACK If you voluntarily provide suggestions, bug reports, feature requests, ideas, or other feedback concerning Remanet, you grant the copyright owner a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, implement, publish, and incorporate that feedback into Remanet without compensation or obligation to you. This section does not transfer ownership of your artwork, exhibition content, project files, or other User Content. ## 11. BETA SOFTWARE Remanet may be identified as beta, preview, experimental, or pre-release software. Beta software may contain errors, incomplete functionality, compatibility problems, or changes that result in projects behaving differently between versions. You are responsible for maintaining appropriate backups of your project files, exported exhibitions, and original media. Remanet may modify, suspend, discontinue, replace, or remove Builder functionality at any time. Discontinuation of the Remanet Builder does not terminate perpetual rights previously granted for legitimately exported exhibitions under the Remanet Export Runtime License. ## 12. NO WARRANTY TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMANET AND THE REMANET BUILDER ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. THE COPYRIGHT OWNER DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, RELIABILITY, AVAILABILITY, COMPATIBILITY, AND DATA PRESERVATION. NO ORAL OR WRITTEN INFORMATION OR ADVICE CREATES A WARRANTY UNLESS EXPRESSLY STATED IN A WRITTEN AGREEMENT SIGNED BY THE COPYRIGHT OWNER. ## 13. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COPYRIGHT OWNER, CONTRIBUTORS, AND PERSONS INVOLVED IN PROVIDING REMANET WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATED TO REMANET. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE REMANET BUILDER OR THIS LICENSE WILL NOT EXCEED THE GREATER OF: 1. THE AMOUNT YOU PAID DIRECTLY TO USE THE REMANET BUILDER DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR 2. FIFTY U.S. DOLLARS (US $50). OPTIONAL DONATIONS DO NOT CONSTITUTE PAYMENT FOR A WARRANTY, SERVICE LEVEL, SUPPORT OBLIGATION, OR EXPANDED LICENSE RIGHTS. Nothing in this License excludes or limits liability that cannot lawfully be excluded or limited. ## 14. INDEMNIFICATION To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the copyright owner from third-party claims, damages, liabilities, costs, and reasonable legal expenses arising from: * User Content that you upload, process, publish, or distribute without sufficient rights; * your unlawful use of Remanet; * your material violation of this License; or * your use of Remanet to infringe the rights of another person. This section does not require indemnification for claims caused solely by the copyright owner's own unlawful conduct. ## 15. TRADEMARKS AND BRANDING Remanet, Remanet.art, associated logos, visual identifiers, and other Remanet branding may function as trademarks or source identifiers regardless of registration status. No trademark license is granted except for incidental display of Remanet attribution as part of a legitimately exported exhibition. You may truthfully state that an exhibition was created with Remanet. You may not use Remanet branding to name, market, or identify another software product, hosted service, distribution, fork, or commercial offering without written permission. ## 16. TERMINATION Your license to use the Remanet Builder terminates automatically if you materially violate this License. Upon termination, you must cease unauthorized use, reproduction, distribution, hosting, or exploitation of the Remanet Builder. Termination of the Builder license does not revoke perpetual rights previously granted under the Remanet Export Runtime License for an Exported Exhibition that was legitimately created before termination. Sections concerning ownership, prohibited uses, User Content, third-party rights, warranties, liability, indemnification, trademarks, governing law, and other provisions that by their nature should survive termination will survive. ## 17. ENFORCEMENT Unauthorized reproduction, redistribution, hosting, modification, or commercial exploitation of the Remanet Builder may violate this License and may also violate copyright, trademark, unfair-competition, computer-access, or other applicable laws. The copyright owner reserves the right to seek any remedies available under applicable law, including monetary damages and injunctive or equitable relief where legally available. Nothing in this License creates a remedy or cause of action that would not otherwise be available under applicable law. ## 18. GOVERNING LAW This License is governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict-of-laws rules. Any dispute arising from this License that may lawfully be brought in state or federal court will be brought in a court of competent jurisdiction located in Texas, unless applicable law requires otherwise. If a more specific venue provision is adopted for Remanet's Terms of Use, that provision should be kept consistent with this License. ## 19. SEVERABILITY If any provision of this License is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will remain in effect. ## 20. NO WAIVER Failure to enforce any provision of this License does not waive the right to enforce that provision later. A waiver is effective only if made in writing by the copyright owner. ## 21. NO ASSIGNMENT BY USER You may not assign or transfer your Builder license or obligations under this License without written permission from the copyright owner. This restriction does not prevent transfer of a legitimately Exported Exhibition as permitted under the Remanet Export Runtime License. ## 22. CHANGES TO THE LICENSE A revised version of this License may govern future use of later versions of the Remanet Builder after the revised terms are presented to and accepted by the user. A later Builder license will not retroactively revoke perpetual rights already granted for legitimately exported exhibitions under an applicable Remanet Export Runtime License. ## 23. ENTIRE AGREEMENT This License, together with any applicable Remanet Terms of Use, Ownership & Privacy disclosures, Remanet Export Runtime License, and applicable third-party notices, constitutes the agreement governing use of the Remanet Builder to the extent those documents apply. If there is a conflict: 1. third-party licenses control the third-party components they cover; 2. the Remanet Export Runtime License controls Remanet Runtime components contained in a legitimate Exported Exhibition; 3. this License controls the proprietary Remanet Builder. ## 24. RESERVATION OF RIGHTS All rights not expressly granted are reserved. The Remanet Builder belongs to Remanet. The artist's work belongs to the artist. The exported exhibition remains the artist's to publish, preserve, move, and maintain under the rights expressly granted for that export.
